Ban is against US Constitution
Huawei, a Tech giant of China, on February 8 started legal
war in its counter-offensive against the United States warning that it could aid
Chinese intelligence services, arguing that legislation Congress passed last
year restricting its business in the United States is “Unconstitutional”.
Huawei argues, in its lawsuit, constitutional principles of
separation of powers and due process is violated in Section 889 of the National
Defense Authorization Act. Company also argues that law violates the Constitution’s
the bill of attainder clause. Case was filed in a US District Court in Plano,
Texas, challenging a 2019 defense bill which puts ban on buying its products,
services, or working with third party that are customer of Huawei.
On the other hand US government argues that Huawei’s
technology produces security risks and may provide backdoor to China.
Basis of the Lawsuit:
Huawei uses US Constitution as a support for its lawsuit,
arguing that the ban is against the constitution. Moreover it states that yet
Congress has not provided any evidence that shows lack of security or security
threat, which is supposedly posed by Huawei devices.
This move may signal to globe that Huawei is ready to turn
all stones, including national courts, to prevent attempts to exclude it from
the race of 5G, which is said future of super-speed telecommunications.
